General and Specific Rental Conditions of a Rental Contract with
LES MAESTROS IMMO
Article - 1: The Owner is deemed to accept these general conditions without reserve. This seasonal rental contract is reserved for the exclusive use of stays in furnished tourist accommodation. The company LES MAESTROS IMMO declares to have a management mandate and to have full disposal and enjoyment during the rental period. The accommodations are rented furnished with kitchen equipment, bedding, as specified in the rental property advertisement.
Article - 2: DURATION OF STAY:
The tenant signing the rental contract concluded for a fixed period cannot, under any circumstances, claim any right to remain in the premises at the end of the stay.
Article - 3: YOUR ARRIVAL:
Arrival times are scheduled for the afternoon from 4 p.m. To facilitate your arrival, we invite you to contact us. Welcomes will be done in our presence at the rental location. Upon arrival, the tenant must arrive on the specific day and at the time mentioned in this contract. In case of late or different arrival, the tenant must notify the lessor.
Article - 4: YOUR DEPARTURE:
Departure times are scheduled in the morning before 10 a.m. To facilitate your departure, we invite you to contact us. Departures will be done in our presence at the rental location. In case of departure outside these hours, the tenant must notify the lessor.
Article - 5: OCCUPATION OF THE PREMISES:
The tenant agrees to occupy the premises personally, to live in them "as a good father," and to maintain them. All facilities are in working order, and any complaints about them occurring more than 24 hours after entering the premises will not be accepted. Repairs necessitated by negligence or poor maintenance during the rental period will be the responsibility of the tenant. This contract is established for a maximum capacity of persons. If the number of tenants exceeds the accommodation capacity, the lessor may refuse additional persons. Any modification or termination of the contract will consequently be considered at the client's initiative.
Article - 6: TENANT'S OBLIGATIONS:
- Cleaning fee is mandatory for rentals. Nevertheless, the tenant agrees to:
- Clean the kitchen,
- Empty the dishwasher,
- Empty and clean the barbecue,
- Deposit glass packaging in recycling bins installed in the municipalities and not leave any waste on the floors (e.g., paper, food, ...).
- Failure to return the accommodation in a clean condition, the Tenant agrees to bear the cost of cleaning that the Landlord will be required to carry out according to the estimate that the latter will have previously requested. The cleanliness of the accommodation upon the tenant's arrival must be noted in the inventory. Cleaning of the premises is the responsibility of the tenant during the rental period and before departure.
- The Tenant will peacefully use the rented accommodation and furniture and equipment according to their destination given by the lease and will be responsible for the damages and losses that may occur during the contract period in the premises of which he has exclusive enjoyment.
- The Tenant will maintain the rented accommodation and return it in good condition of cleanliness and rental repairs at the end of the contract. If items from the inventory are broken or damaged, the Landlord may require their replacement value or the price of cleaning the premises, dirty blankets, compensation for damages of any kind concerning curtains, wallpapers, ceilings, carpets, windows, bedding, etc.
- The tenant will respect the maximum number of people allowed to enter the premises. Failure to comply with these conditions may result in immediate cancellation of the contract.
- The tenant may not object to the visit of the premises when requested by the owner or his representative.
- It is strictly forbidden to install caravans, tents, or campers even periodically. Camping on the property is strictly prohibited. If this clause is not respected, the contract may be terminated immediately.
- Parking of vehicles:
- It is strictly forbidden to park any type of vehicle on the lawns. Areas designated for this purpose will be recommended or made available to you.
- The tenant must avoid any noise likely to disturb the neighbors, particularly those emitted by sound equipment, television, and others.
- The Tenant may not make any claim against the Landlord in case of theft and damage to the rented premises.
Article - 7: RESERVATION AND PAYMENT OF RENTAL:
The reservation becomes effective as soon as the tenant returns a copy of the contract accompanied by payment of a deposit amounting to 25% of the total amount. In the case of payment by bank transfer, we thank you for indicating:
- Your name
- The date of your stay
- And ideally the name of the house
- The balance of the rental is paid 1 month before arrival. A second copy of the contract is to be kept by the tenant. The rental concluded between the parties to this act cannot, under any circumstances, benefit even partially to third parties, natural or legal persons, without the written consent of the lessor. Any infringement of this last paragraph would be likely to lead to the immediate termination of the rental to the detriment of the tenant, the proceeds from the rental remaining definitively acquired by the lessor. Our agency accepts payment by credit card or bank transfer and secure payment on the booking site www.lesmaestros-immo.com.
Article - 8: SECURITY DEPOSIT:
Upon arrival, a security deposit is requested by the owner or his representative. Its amount cannot exceed the total cost of the rental. The owner or his representative has the right to cash the security deposit in case of breach by the tenant. It is returned to the tenant, after a contradictory inventory of exit or sent to him within a period of 7 days, deduction made, if necessary, of the cost of restoration of the premises and replacement costs of the elements and equipment made available. This period cannot exceed 60 days. If the deposit is insufficient, the tenant undertakes to make up the difference, based on justifications given by the owner or his representative.
Article - 9: INVENTORY:
A document is drawn up jointly and signed by the tenant and the lessor or his representative on arrival and departure from the cottage. This document constitutes the only reference in the event of a dispute concerning the inventory. This document is given to the tenant upon arrival. The tenant agrees to check this document, report any anomalies by sending them to the following email address immobilier@lesmaestros.com within 24 hours at the latest after his arrival. No claims will be considered beyond this period. This document will serve as a contradictory inventory between the two parties. The tenant agrees to take the rented premises in the condition in which they will be upon entry into possession as they will have been described.
Article - 10: CANCELLATION POLICY:
- Cancellation by the Tenant:
- Any cancellation must be communicated via registered postal mail (address: 6b, rue Fulgence Bienvenue 22300 Lannion) or electronically (immobilier@lesmaestros.com) to the contracting party.The consequences of a cancellation result in the collection of fees variable depending on the date on which it occurs. The following scale is applicable:
- Cancellation more than 90 days before your scheduled arrival: No cancellation fees will be charged.
- Cancellation between 90 and 30 days before your scheduled arrival: 50% of the total rental amount will be charged.
- Cancellation less than 30 days before your scheduled arrival: 100% of the total rental amount will be charged.
- These cancellation fees may be covered by a cancellation insurance to be individually subscribed to by the tenant. Regardless of the reason for cancellation, the tenant must notify the landlord by registered letter with acknowledgment of receipt, with the date of receipt of this notice determining the applicable fee scale. Failure to notify the landlord will result in the tenant being liable for the full payment.
- Cancellation by the Lessor:
- If a force majeure event leads to the destruction of the property or the impossibility of making the property available, all sums paid will be refunded to the tenant, without any further refund.
- COVID Clause:
- Exceptional measures have been implemented in view of the health crisis related to the spread of the coronavirus and its derivatives and variants, or any comparable virus.If a request to cancel a stay is made by the tenant for at least one of the two reasons and according to the conditions below, the tenant may receive a full refund of the rental price.The refund will be granted to the tenant if they provide justification for the reasons described below, which must be related to the Covid-19 pandemic and its derivatives and variants or any comparable virus:
- Presentation of a medical certificate from the holder of the rental contract, stating the inability to stay in the premises subject to this contract.
- In the event of confinement or travel restrictions related to Covid-19.
- To benefit from the refund of the rental price, the tenant must request cancellation from MAESTROS IMMO no later than the day before the first day of the rental, citing the condition in effect from the relevant official authority on the first day of the rental.
Article - 11: INTERNET ACCESS:
All our rentals have internet access. The tenant agrees not to use it for the reproduction, representation, provision, or communication to the public of works or objects protected by copyright or neighboring rights—such as texts, images, photographs, musical works, audiovisual works, software, and video games—without authorization. Failure to comply with these obligations may lead to the tenant being accused of infringement (Art. L. 335-3 of the Intellectual Property Code). The tenant agrees not to access illegal websites or use illegal downloading software.
Article - 12: PETS:
It is specified in the advertisement whether pets are allowed or not.
- Pets Allowed:
- Pets will be accepted provided that the tenant agrees not to allow their pet into the bedrooms and ensures to clean up after them. Failure to comply with these conditions may result in the landlord requesting a disinfection and cleaning fee of €300 from the tenant.
- Pets Not Allowed:
- Pets are strictly prohibited on the rented property. In case of non-compliance with this clause by the tenant, the lessor may cancel the stay. In this case, no refund will be made. However, we invite you to contact us to discuss your pet. Under certain conditions, we may be able to accept your pet.
Article - 13: INSURANCE:
The tenant is responsible for all damages occurring due to their actions. They are required to be insured by a holiday-type insurance contract for various risks. The tenant agrees to insure against rental risks (fire, water damage). Failure to have insurance in the event of a claim will result in damages and interests. A copy of the insurance policy may be requested by the Landlord from the Tenant upon entry into the premises. The landlord undertakes to insure the property against rental risks on behalf of the tenant, the latter or having the obligation to notify them, within 24 hours, of any damage occurring in the accommodation, its outbuildings, or accessories.
Article - 14: CONCIERGE SERVICE:
A private concierge service is also available to you free of charge during your stay. Delivery of meals, bikes, and groceries before your arrival is possible upon reservation. Body care, yoga classes, themed evenings (e.g., pancake evenings or birthday parties), suggestions, and reservations for activities are also possible. However, the costs of these services will be borne by you.
Article - 15: BASIC EQUIPMENT IN THE RENTED PROPERTY:
Upon your arrival and to start your stay off right, the following will be provided: 2 rolls of toilet paper per toilet, 3/4 dish towels, 5 dishwasher tablets, 5 laundry detergent tablets, 1 sponge, trash bags. We invite you to inquire about the condiments available in the house: oil, vinegar, salt, pepper, etc. It is understood that we provide all this to start your stay. You will need to purchase additional items for your stay. Shampoos and shower gels are not provided.
Article - 16: DOMICILE ELECTION:
For the execution of these terms, the Landlord and the tenant elect domicile in their respective residences. However, in the event of a dispute, the court of the Landlord's domicile shall have sole jurisdiction. This contract and its consequences are subject to French law. Regarding disputes, any claim regarding the condition of the premises and the description during a rental must be submitted within 3 days from entering the premises by email to the following email address: immobilier@lesmaestros.com.
